該怎麼用英文說出盜圖、仿冒、抄襲等行為呢？
就讓我們透過對話討論，
一起聊聊這個議題！
抄襲的行為不管在學術上或是商業環境中都是屬於非常嚴重的犯罪。隨著網路資訊發達、資源無遠弗屆，抄襲、盜用等行為更是成為跨越國界的重要議題。藝術家被指控使用未經授權的圖片進行再製與創作、網路上任意轉載他人作品衝流量賺取廣告收入等狀況層出不窮，原生創意與剽竊的界線也變得越來越模糊。今天小編要介紹幾個抄襲與盜用作品的相關詞彙，同時也從帶大家透過對話學習抄襲相關英文。
學會下面五個單字，先來聊聊抄襲的說法：
- Plagiarism (n.) 抄襲；抄襲品
動詞為 plagiarize 形容「剽竊」的行為。在此作為名詞，可以形容抄襲的行為或是抄襲而來的作品。
The university decided to fire that professor for committing plagiarism and falsifying data.
這所大學決定解聘那位在研究中抄襲與偽造數據的教授。
- Rip off (v.) 猛地撕掉；竊取
Rip 動詞本身為描述「快入撕下或劃破；複製」的行為，除此之外在這裡表示為「強行竊取，未經同意的盜用賺取私利」某件事物。如果是以 rip someone off 的句型，則解釋為「敲某人竹槓，佔其便宜」的意思。
He rips stuff off from pharmacies to sustain his drug addiction.
他從藥局竊取物品來滿足毒癮。
- Originality (n.) 原創性
Original 為形容詞，表示為「獨一無二，獨具創造性的」，加上 -ity 作為名詞，解釋為創作者的「獨創性」。
Originality measures the ability to produce ideas that are totally new or unique.獨創性是以產生全新或獨特點子的能力來衡量的。
- Copyright infringement (n.) 侵犯版權
Copyright 為各種「智慧財產權，著作權」的總稱，包含如複製、演繹、公開展演權等。Infringement 則是指任何「法律或規定上的違反」，在此兩者組合解釋為對他人版權的侵犯行為。
It is a criminal offense for a person to conduct willful copyright infringement.任何人故意侵犯版權都屬於刑事犯罪。
- Royalty (n.) 版權費；版税
Royalty 雖然也指「皇室成員，皇室家族」的意思，但在此表示為類似為了享有他人財物的優先使用權而需支付的費用，例如專利使用費、創作品的版稅、土地開採費、租用費等。
According to our contract, we will receive a 10% royalty for each copy sold.
根據我們的合約，我們每賣出一份都可收取 10% 的版稅。
學會了以上關於抄襲的相關詞彙後，接下來讓我們來看看 Ashley 與 Chris 對於抄襲新聞的看法：
Ashley: What do you think of these two pictures? Don’t you think they look exactly the same? I hate to see this kind of plagiarism where it’s just ripping off the originality of its creator.Ashley：你覺得這兩張圖怎麼樣？你不覺得它們看起來完全一樣嗎？我討厭看到這種抄襲作品剝奪了創作者的原創性。
Chris: I totally agree. The only difference here is probably the colors. Has the creator filed a formal lawsuit for copyright infringement yet?
Chris：我完全認同。這裡唯一的區別可能只是顏色的不同。不知道原創者是否已經正式提起版權侵權訴訟了呢？
Ashley: I hope so. The second artist has made an official announcement on her social media page this morning denying the accusations. She admitted using the materials as a reference, but the creation of the new piece is entirely her own interpretation.
Ashley：希望如此。第二位藝術家今天早上已經在她的社交媒體上正式否認這項指控。她承認參考這些材料，但是新作品完全是她自己的詮釋方式。
Chris: If that’s the case, why do the designs look identical? Some kind of coincidence!
Chris：如果是這樣，為什麼設計看起來如出一轍？也太巧了吧！
接下來學會 5 個單字，來聊盜圖跟版權：
- Appropriation (n.) 挪用，盜用
Appropriation 除了「為某目的特別撥款」的意義外，也表示將他人財物「據為己有，盜用」的意涵。
He lost his job when he was found responsible for the appropriation of company funds.
他因為被發現挪用公款而失去了工作。
- Violation (n.) 侵犯；違背
Violate 為其動詞形態，皆表示對於法律、協議、原則的違背與侵犯的意涵。通常會在後方加上 of 連接侵犯的法律或原則，例如 violation of human rights（侵犯人權）、violation of international law（違反國際法）等。
She’s claiming that his newly-released single is a violation of her intellectual property.她聲稱他新發行的單曲侵犯了她的智慧財產權。
- Portrait rights (n.) 肖像權
Portrait 指個人的肖像， rights 為權利，通常在泛指一個領域的權利時，會以複數表示，例如 women’s rights（婦女權利）、civil rights（公民權）。肖像權是指肖像的任何主體對其肖像、個人形象、外表、個人特徵或其它個人屬性的權利，尤其在商業用途上的獨有權。
Everyone captured on photograph or video is automatically entitled to portrait rights.
在照片或影片上被拍攝到的每個人都自動地享有該作品的肖像權。
- Freebooting (n.) 盜取他人創作而牟利
原意來自荷蘭語中「掠奪，洗劫」的意思。現在則專指截取他人網路媒體上的圖像等創作，重新上傳到自己的空間，並藉此不勞而獲得到流量或關注，從中牟利的違法行為。同樣有類似單字起源的，還有 pirate 這個動名詞。原本是指海上掠奪財物、蠻橫無理的海盜們，而後衍生出盜取他人智慧財產創作、非法複製販賣謀取利益的行為。
Someone reposted my video to their YouTube channel, and now their copy went viral. I can’t believe they’re freebooting me like this!有人將我的視頻轉發到他們的 YouTube 頻道，現在他們的版本竟然人氣竄升。我不敢相信他們會像這樣盜取我的創作！
- Crib (v.) 抄襲，剽竊；作弊
Crib 作為名詞還有「嬰兒床；溫馨的小窩」的意思，但同時在口語中也有「仿冒品，抄襲」全然不同的解釋。和 copy、plagiarize 相比，crib 較不正式而情節比較輕微。
I wonder which artist he cribbed that crazy idea from.我想知道他從哪個藝術家那裡抄襲了那個瘋狂的想法。

Amanda: I love this picture! I will definitely order the poster and hang it on my wall.Amanda：我好愛這張圖片！我一定會訂購海報並掛在牆上展示。
Chris: Haven’t you seen the news? The artist was accused of appropriation and violation of portrait rights.
Chris：你沒看新聞嗎？這個藝術家被控盜用圖片和侵犯肖像權。
Amanda: I have heard about it. But I also read that he has purchased the picture from a credible stock website with commercial use authorization.
Amanda: 我聽說了。但我也讀到，他是從一個可靠的圖庫網站購買了這張照片的商業用途授權。
Chris: Really? I still feel very doubtful about him. He had been suspected of freebooting in the past on several occasions.
Chris：真的嗎？我對他還是存疑。他在過去曾多次被懷疑盜圖。
Amanda: Well, I believe that many good works came from imitating or learning of other inspiration. If he’s using a legitimate resource to express his original ideas and talent, we should support that!
Amanda：嗯，我相信很多好的作品都源自於模仿或學習其他創作靈感。如果他用合法的資源來展現自己的原創想法和才能，我們應該支持！
