刑事檢控專員梁卓然請辭 內部電郵透露與鄭若驊意見不合 沒被要求參與國安法案件

消息人士向《立場新聞》透露,刑事檢控專員梁卓然今日向律政司發內部電郵,透露自己已於本周初請辭,將於年底離職。據悉,梁卓然在電郵中透露與律政司長鄭若驊在工作上意見不合。

梁卓然 2017 年 12 月獲委任為刑事檢控專員,掌管律政司刑事檢控科,在刑事檢控科已工作 25 年。刑事檢控專員屬律政司刑事檢控科最高級人員。

《立場》獲悉的電郵內容顯示(全文見文末),梁卓然在電郵透露自己與鄭若驊在刑事檢控科的工作上意見不合,情況在一段時間後仍未得到改善,梁卓然形容情況不幸 (It’s most unfortunate that I do not see eye to eye with the SJ on the running of the PD, and the situation has not improved with the passage of time)。梁卓然電郵中指,這個情況不利於刑事檢控科的順暢運作,亦非他作為已服務部門 25 年、及身為部門主管所樂見的,因此他認為,由其他人擔任刑事檢控專員,對鄭若驊及刑事檢控科而言是最好的,讓新意見及視角帶入刑事檢控科。

電郵透露近日內部人手調動 應對包括國安部運作

梁卓然又在電郵中提到,明白部分同事對於近日突然的崗位調動、及調動至處理國家安全案件的相關部門,所造成的不確定性有所關注(I understand a number of you are concerned about the uncertainty of a sudden posting to another division or the division/unit handling National Security Cases)但就國安法案件而言,梁卓然指自己無法為同事提供額外資訊,因為他並沒有被要求參與相關事宜或提供協助。

梁卓然又在電郵中指,擔任檢控官是一份艱難但榮幸的工作,檢控人員從來不是為了爭取被告定罪,而是要確保所控告的罪名,合適反映被告所犯罪行及案件的證據,並要確保審訊過程中作適當披露,確保被告獲得公平審訊,及適當的刑期。

梁卓然指,上述工作需要檢控人員經常提醒自己是公義的執行者(ministers of justice),檢控人員應為此感到驕傲,並要確保每個檢控決定、每一場審訊和上訴,都要由其他持份者評斷,他們是否已達到作為一名公平及有能力的檢控官的最高標準。梁卓然指,自己享受每一天在刑事檢控科工作的時光,形容多年來與同事共事是榮幸。

鄭若驊證實接獲梁請辭 拒絕評論

鄭若驊在今日記者會上回應稱,已收到梁卓然的請辭,但指為公平起見,會待對方作公開聲明後才會評論,又稱現時會專注於更重要的事務。

律政司其後發新聞稿,指鄭若驊一直「以客觀和專業的態度」處理律政司的工作,亦「尊重同事的意見」,但鄭認為不適宜、亦不應該公開評論或披露律政司的內部溝通。至於刑事檢控專員的繼任人選,律政司會根據既定程序作出適當安排。

梁卓然現年 53 歲,1992 年在香港取得律師資格,1998 年成為大律師,2015 年獲委任資深大律師。1995 年加入律政司刑事檢控科,任職檢察官,1997 年晉升為高級政府律師。他在 2009 年成為副首席政府律師,2013 年 12 月再擢升為首席政府律師。梁卓然自加入律政司以來,一直在刑事檢控科工作,2012 年年起擔任副刑事檢控專員。

梁卓然近年親自處理的案件,包括控告戴耀廷、陳建民公眾妨擾的「佔中九子案」。

Dear Colleagues

Earlier this week I have tendered my resignation and will be stepping down as DPP and leaving the civil service on 31 December 2020, allowing ample time for a smooth transition and handover.

It is most unfortunate that I do not see eye to eye with the SJ on the running of PD, and the situation has not improved with the passage of time. This is not conducive to the smooth operation of PD and certainly not something that I, as a prosecutor serving the Division for 25 years and the current head, would like to see. It will be best for the SJ and the Division to have a new DPP so that new ideas and visions can be brought in.

I enjoy every single day working in PD, particularly the time in court. It has been my honour and pleasure to have worked with you over the years, during which I have gained invaluable experience, fond memories and great friendships.

Being a prosecutor is a difficult but honourable job. We never strive to get a conviction. Rather, we ensure that the charges laid are a proper reflection of the criminality on the available evidence, proper disclosure has been made, the defendant has a fair trial and finally the sentence passed is within range.

This requires a constant reminder to ourselves that we are ministers of justice, something that we should be proud of and feel privileged. Every prosecutorial decision that you make, every trial or appeal that you conduct, is constantly measured by all the other stakeholders of the criminal justice system to see if we have achieved and maintained the high standards required of a fair and competent prosecutor.

To this end, I am proud to inform you that I have received many positive feedbacks from judges of your performances. Judges wrote in not because of the verdict, one way or the other. Rather, they wrote in stating he/she was impressed with the fair and measured way in which you conducted the prosecution, or in appeal cases, the fairness and the conciseness of your submissions and the most helpful assistance that you have provided the court with.

Recently, I understand a number of you are concerned about the uncertainty of a sudden posting to another division or the division/unit handling National Security Cases. As to the former, the inter divisional transfer scheme has been in place to cater for operational needs and career development of counsel and in so far as practicable, counsel will be given sufficient notice of the intended transfer. As to National Security Cases, I do not have information for you as my assistance and participation in those matters have not been required.

I would like to take this opportunity to thank each of you for your hard work and support in the past and I am sure you will continue with your good work in support of the SJ and the new DPP. 

I wish each of you and your family good health despite the difficult epidemic situation we are having in Hong Kong. Take care.
